Paintings in the monument protection legislation of Ukraine: problems of preservation and restoration of movable cultural values

Abstract: 

The article is devoted to the legal framework of the preservation and restoration of paintings in Ukraine: laws and international treaties governing the monuments protection. The purpose of the article is to analyze the main legal regulations governing the protection, preservation, conservation and restoration of paintings in Ukraine.

The laws of Ukraine “On Protection of Cultural Heritage”, “On Museums and Museum Business”, “On Export, Import and Return of Cultural Values” were analyzed in the context of protection and preservation of paintings. The main conventions and recommendations of UNESCO on the protection of cultural values were identified. The Venice Charter and ICOMOS principles for the preservation and conservation-restoration of wall paintings in the context of preservation and restoration of paintings were considered.

The Law “On Protection of Cultural Heritage” applies to immovable monuments, therefore its scope may cover only wall paintings. According to the law, easel paintings do not belong to the category of cultural heritage objects, while fall under the category of “movable cultural values”; their protection, preservation and restoration are regulated by the laws “On Museums and Museum Business”, “On Export, Import and Return of Cultural Values”. In Ukraine, the State Register of Immovable Monuments of Ukraine and the State Register of National Cultural Heritage simultaneously operate.

It was noted that the main legislative acts in the field of monuments protection in Ukraine meet the requirements of international law, but the problem lies in the lack of enforcement. Problematic issues in the field of protection, preservation and restoration of paintings were identified: inadequate level of implementation of Ukrainian monument protection laws, violations of the law (vandalism and destruction of monuments, illegal trade in cultural property), insufficient funding, imperfect protection of objects.
